POWER OF SALE APPRAISAL
Power of Sale is the most common remedy available to lenders in Ontario when a mortgage is in default. The power of sale process gives the mortgagee (the lender) the legal authority to evict the homeowner and sell the property to recover the outstanding mortgage debt, interest and expenses. The homeowner retains the right to any profit remaining from the sale after the outstanding debt has been recovered along with the expenses and fees associated with the sale. Because the homeowner retains this right, the lender has a legal obligation to sell the property at market value.
Lenders proceeding with a power of sale should obtain an appraisal to support the sale price. Two appraisals, from different appraisal firms, are preferable in order to demonstrate that the lender is fulfilling their obligation to sell the property at market value. Power of sale appraisals are met with a higher level of scrutiny and require more due diligence than a traditional appraisal. A high quality, detailed and professional appraisal report with an accurate assessment of the value, condition and marketability of the property is of utmost importance. We provide only full appraisals for power of sale purposes. We do not provide desktop or drive-by appraisals for power of sales due to the higher risk associated with this type of assignment. We provide power of sale appraisals for residential properties ranging from single family dwellings up to three units only. Reports are completed within two business days of property inspection for most assignments.
